2. Collection and processing of personal data

When you visit our website or contact us via our request form (room or table reservations), we process the personal data you provide. This includes in particular:

  • Name, address, phone number, e-mail address

  • Stay-related information (arrival and departure dates, number of persons, room requests)

  • Restaurant reservation details

This data is processed solely for the purpose of handling your request and fulfilling the contract.

3. Purposes and legal bases

We process your data for the following purposes:

  • Handling and responding to inquiries (Art. 6 para. 1 lit. b GDPR)

  • Fulfilling contractual obligations (Art. 6 para. 1 lit. b GDPR)

  • Compliance with legal obligations (Art. 6 para. 1 lit. c GDPR)

  • Safeguarding legitimate interests such as IT security and website optimization (Art. 6 para. 1 lit. f GDPR)

4. Use of WIX and databases

Our website is operated via WIX.com Ltd. (40 Namal Tel Aviv St., Tel Aviv, Israel). WIX may store data on servers outside the EU (e.g. USA, Israel). Data transfers are based on EU adequacy decisions and standard contractual clauses, ensuring an adequate level of data protection.

The data you enter via our forms is stored in the WIX database to enable us to process your request.

5. Disclosure of data

We only transfer personal data to third parties if this is necessary for the performance of a contract (e.g. payment providers, tax advisors, public authorities) or if you have expressly consented to it.

6. Storage period

We store personal data only for as long as necessary to fulfill the purposes stated and as required by legal retention obligations. After these periods, the data is deleted.

7. Cookies and tracking

Our website uses cookies to enable basic functions, analyze usage, and improve our services. You can prevent the storage of cookies by adjusting your browser settings; however, this may limit certain functionalities of the website.

8. Rights of data subjects

You have the right to:

  • Obtain information about your stored data (Art. 15 GDPR)

9. Right to lodge a complaint

If you believe that the processing of your personal data violates applicable data protection law, you have the right to lodge a complaint with the competent supervisory authority. In Austria, this is the Data Protection Authority (www.dsb.gv.at).

Privacy Notice regarding Registration Data and Guest Card

1. Registration Data

1.1 Legal Obligation to Register

According to the Austrian Registration Act, you are obliged to register with us using the data specified in §§ 5 and 10 of the Registration Act. This includes the following data:

Name, date of birth, gender, nationality, country of origin, address including postal code and – for foreign guests – type, number, issuing authority and issuing country of a travel document, as well as the dates of arrival and departure.

1.2 Guest Register

We are legally obliged to maintain a guest register in accordance with § 19 of the Registration Act Implementation Ordinance. The data will be stored for a period of seven (7) years, unless processed for other purposes specified in this privacy policy.

The guest register is kept electronically. For this purpose, the data will be transmitted to an IT processor and stored locally. No transfer to third countries takes place.

1.3 Transfer of Data

The categories of data “arrival” and “departure”, linked with “country of origin”, are transmitted to the municipality in which our accommodation is located, in accordance with § 6 of the Tourism Statistics Ordinance.

Aggregated data regarding the total number of overnight stays and the number of guests liable to pay the local residence tax are also forwarded to the Naturparkregion Reutte Tourist Board, of which we are a member, and/or to the municipality. This is based on § 19 of the Tyrolean Residence Tax Act.

The processing activities pursuant to sections 1.1 to 1.3 are based on Art. 6 (1) lit. c GDPR.

1.4 Additional Data Transmission to Tourist Board / Municipality

In addition, your postal code and year of birth (in pseudonymized or anonymized form) are transmitted to our municipality and tourist board for statistical purposes (origin and age statistics).

This processing is based on Art. 6 (1) lit. e (task carried out in the public interest) and Art. 6 (1) lit. f (legitimate interests) GDPR. You may object to this processing at any time on grounds relating to your particular situation (Art. 21 (1) GDPR).

2. Guest Card

2.1 General Information

You have the option to request a guest card. The guest card entitles you to discounts and/or benefits at various companies and attractions in the region (e.g. reduced admission). It is valid for the duration of your stay with us.

2.2 Issuing the Guest Card

The guest card will only be issued upon your request. Depending on the system used by the tourist board (TVB) and/or the accommodation provider, the card may be issued as:

  • an electronically generated guest card,

  • a manually created guest card, or

  • the duplicate of the registration form.

2.3 Processed Personal Data

For both electronic and manual guest cards, the following data (derived from your registration data) are processed:

First name, last name, date of birth, country of origin/postal code, and duration of stay (arrival/departure).

If the guest card is issued in the form of the registration form, it will contain the data required by § 5 in connection with § 9 of the Registration Act. In this case, no electronic processing takes place for the purpose of the guest card.

When using the guest card, the following additional data are processed: usage cycle of the card, services used, bookings, transaction logging, references to the registration data and the accommodation provider.

This data is required to verify identity, determine the validity period of the guest card, and enable billing of the benefits between service providers, the tourist board, and the accommodation providers.

2.4 Legal Basis of Processing

The processing of data for the purpose of the guest card is based on your consent (Art. 6 (1) lit. a GDPR).

You may withdraw your consent at any time, either verbally with the accommodation provider or in writing to gasthof-klause@ehrenberg.at.

2.5 Operation of the Guest Card System

The guest card system is operated by the local tourist board (“TVB”). Local accommodation providers and companies (“service providers”) are also involved.

The data processed for the guest card will be deleted after forty (40) months, unless further processing takes place for other lawful purposes (e.g. registration obligations).

2.6 Recipients of Data

The local tourist board receives the data for the purpose of settlement with service providers and/or accommodation providers.

Service providers that grant discounts based on the guest card will also receive the relevant data when you use their services.

In order to use the discounts, you must present your guest card to the service provider.

 

The provider verifies its validity either by scanning the barcode (electronic card) or by checking the registration form (paper card). In doing so, personal data such as your identity and date of birth may be verified.
